ethics trial. lebron james mentioned in the same breath as barack obama, mark zuckerberg, and hu jintao. why? we'll tell you. first let's get to the news live at 5:30 a.m. at 30 rock in new york, city. with less than two weeks before the thanksgiving travel rush some airline pilots are now pushing back over new body scans and enhanced pat-downs at the nation's airports, which many travelers consider invasive and harmf harmful. even hudson river chelsea sully sullen berg says he has detected growing unease with the measures. officials are struggling to insure outraged passengers who are being groped more closely than ever. janet napolitano is reiterating points she made in a column published in "usa today" saying her agency has a, quote, open ear to any adjustments to the security measures but napolitano adds that if people want to travel by some other means, they have that right.

meanwhile, a bipartisan group of new jersey politicians is asking the government to review the practice of full body scans. the growing controversy surrounding screening comes after a california man was forced to leave san diego's airport for refusing to let security officers use full body imaging or pat him down. telling them, quote, if you touch my junk i'll have you arrested. that's a real quote. we'll see how long -- they're getting closer and closer to certain areas in the pat-downs we hope they'll turn back on. in a sharp reversal, to polit politics, mitch mcconnell says he supports plans for a moratorium on earmarks. mcconnell who over the past three years has sponsored over $450 million in earmarks, said yesterday that the midterm elections are proof that voters want a change in how federal tax dollars are spent. >> the democrats were ignoring the wishing of the american people. when it comes to earmarks i won't be guilty of the same thing.

make no mistake, i know the good that has come from the projects that i've helped support throughout my state. i don't apologize for them. but there is simply no doubt that abuse of this practice has caused americans to view it as a symbol of the waste and out-of-control spending that every republican in washington is determined to fight. >> mcconnell said the earmarks he laid out for his state were, quote, vital. that surprising reversal gave a victory to jim demint who's been pushing a freeze on earmarks. >> if we can't decide as a federal judge it's not our job to pave local parking lots and build local museums we don't understand what constitutional limited government is. if the senate republicans fail to pass a ban on earmarks tomorrow, obviously they have not gotten the message. >> down with paved parking lots. in a statement john boehner, the presumptive new speaker of the

house, also called for an end to earmarks saying, quote, an earmark moratorium shows elected owe fish are serious about restoring trust between the american people and those who are elected to represent them. president obama added his support saying i welcome senator mcconnell's decision to join me and members of both parties who sup port cracking down on wasteful earmark spending which we can't afford during these times. as a senator i helped eliminate earmarks and as a president i've called for new limitations on earmarks and set new higher standards and transparency and accountability as we can't stop with earmarks that represent only part of the problem. i look forward to working with democrats and republicans to bring down our deficits for children as the president points out, earmarks a symbolic, a tiny sliver of our financial economic problems. senate republicans are planning to vote today and with mcconnell's backing it is expected to pass. latest tally shows write-in candidate lisa murkowski is

holding on to a narrow lead in the undecided alaska senate race. the incumbent senator ahead of joe miller by 1700 votes right now. murkowski is lobbying criticism at former governor sarah palin who endorsed miller this year in the republican primary. in an interview last night with cbs news, murkowski said she could not support palin for president, should she run in 2012, citing palin's lack of, quote, intellectual curiosity. >> what's up with your relationship with sarah palin? can you explain it? >> i'm still her senator. i'm going to work hard it to represent her too. we don't really have much of a relationship. >> you have said you would not support sarah palin for president because she's not worldly enough. >> i just do not think that she has those leadership qualities that intellectual curiosity, that allows for building good and great policies. you know, she was my governor

for two years, and i don't think that she enjoyed governing. >> ballots are still being counted but mur cousy's camp appears confident she will come out on top. an ethics package will continue deliberations on charlie rang whole walked out of hearings yesterday after he was denied more time to raise money for a lawyer. >> 50 years of public service is on the line. i truly believe that i'm not being treated fairly and that history will dictate that notwithstanding the political calendar, be i am entitled to a lawyer during this proceeding. i am being denied the right to have a lawyer right now because i don't have the opportunity to have the legal defense funds set up and because i can't afford another million dollars.

i can't even promise that to counsel. >> you'll be surprised to know congressman rangel not getting the full support of "the new york post" calling him "trial buff foon" as he walks out. absent much of process the subcommittee unanimously agreed there was and is evidence to support 13 counts of misconduct. among the accusations as you know by now, not paying some taxes and getting special deals on rent-controlled apartments. however there was a bright spot for rangel yesterday when the top ethics committee lawyer said the former weighs and means committee chair rangel is not corrupt. >> i see no evidence of corruption. do i believe based on this record that congressman rangel took steps to enrich himself? based on his position in congress? i do not. i believe that the congressman was overzealous in many of the things that he did, and at least sloppy in his financial -- his

personal finances. >> just overzealous. rangel put out a statement, the committee he said has deprived me of the fundamental right to counsel and has chosen to proceed as if it is fair and impartial and operating according to rules when they are depriving me of my rights. i hoped i would be judged by my entire record that determines that i have been a credit to the house, to my family and friends and supporters who have entrust med with this duty. they will try to determine whether rangel did violate house rules. if he's found guilty experts say he will likely face a public reprimand but not expected to be expelled from the house. the congressal black caucus is withholding its endorsement. a potential road block to nancy pelosi's bid to remain leader. after a nearly two-hour long meeting barbara lee of california said the 42-member organization would only endorse caucus member jim clyburn of south carolina. >> we fully support our current

whip, mr. clyburn, for the number three position, and we're currently reserving judgment on the entire package until we see what the actual portfolio entails in terms of responsibilities. >> lee added that discussions would continue over the coming days. house democrats and republicans are holding their leadership elections tomorrow. california supreme court has ruled that illegal immigrants are entitled to the same tuition breaks offered to in-state high school students to attend public colleges and universities. the unanimous decision reverses a lower court ruling, siding with opponents of the law who said it unfairly favored illegal immigrants over u.s. citizens who live outside california and charged higher tuition rates. while the ruling applies only to california the case was watched closely on a national level because nine other states including new york and texas have similar laws. the case will now be appealed to the united states supreme court. and in the new report

scheduled to be released today a congressional panel warns the foreclosure document crisis could have severe consequences for the economy. in the worst case scenario the panel says banks will choke on the vol umg of bad loans they could be forced to reabsorb, leading to another financial crisis. however the panel allowed for the possibility that concerns over paperwork irregularities could prove to be in the end overblown. all right. let's get into more business now as we get all up in your business. cnbc's geoff cutmore is live in lond london. good morning, geoff. >> good morning. overseas retail sales strong in the u.s. for october, 1.2%. that was better than the expectations. autos, the big standout in that area, it would seem that americans are prepared to spend again. so fascinating story. will they be buying apple songs from itunes. apple, with an announcement, we're expecting it some time

♪ it's just ugly outside. up and down the east coast, there's washington, looks that way in new york too. let's get a check on weather from nbc meteorologist bill karins. good morning. >> i'm okay with it. we're in a pattern where the bad weather is during the middle of the week and the weekends are shaping up all right. >> well said. >> so a little tease looking ahead this upcoming weekend doesn't look that bad for everyone on the east coast. just have to get through the next two days. the roads are wet pretty much from florida north all the way into new england. light rain now moving into boston. overnight we've had light rain in connecticut and road island and down in new york city. it's not going to rain all day.

it's not going to be a heavy rain either. just going to be light on and off drizzle and showers and that's what we have from d.c. to bo baltimore to new york city. it's not really cold. sometimes you get the november rain storms and it's freezing out too. temperatures will be in the 50s and 60s up and down the east coast. it could be worse. highs around 58 degrees from d.c. all the way to new york. even boston won't be all that cold for this time of year. even the high peaks of new england this will be all rain. they were hoping to get some of the fresh snow coming into the thanksgiving holiday break. as far as other forecasts concerns today, down in florida a tornado watch. if we're going to get any bad, severe storms it's going to be from pensacola, to tallahassee on i-10 this morning, only about the next two or three more hours. we'll watch jacksonville and savannah and friends in charlton, they could see severe storms today. it's just the southeast. if there's going to be airport delays, possibility of atlanta delays, and, of course, with the low visibility in new york and

newark you're going to get delays anyway. middleth country looks great. out west just beautiful weather for california and friends on the west coast. we get this today, the rain holds on for early tomorrow, and then it will clear out on wednesday afternoon. >> all right. could be an ugly airport day. check it out. turning to sports if you went to bed early last night you missed a show put on by michael vick. hours before the game it was donovan mcnabb, the former eagle, who signed a five-year, $78 million contract extension with washington, $40 million is guaranteed. the deal was struck before mcnabb and the redskins hosted the eagles. mcnabb had nothing to do with the outcome of this game. the story was that man, eagles quarterback michael vick, on the very first play from scrimmage, vick rolls out left, fires a bullet to desean jackson. how about that to start the game? 88 yards for the touchdown.

jackson walks in backwards 7-0 eagles. later in the quarter, first and goal, vick doesn't find anybody. he does what he does, leaves job strap at the 5 yard line, dives in for the touchdown 14-0 before you could blink. more vick, beautiful play here, shovel pass to mccoy, he goes 11 yards, 21-00 eagles. bomb, vick to mack lin, makes a great catch, falls into the end zone, 48-yard touchdown. 35-0, philly. that was the first play of the second quarter. now to the third quarter, third and goal, vick pump fakes rolls right, buys himself time, fires into the back of the end zone. jason avant, 3-yard touchdown, 52-21, eagles at that point. philadelphia puts on a clinic, goes on to win 59-28. vick finished with 333 passing yards. six total touchdowns. four of them passing. he ran for two more. after the game he spoke about the domination of the redskins.

she won some and lost some, but sarah palin definitely left her mark on the 2010 midterm elections. one publication honoring the former alaska governor for her recent contribution to the english later. we call this sound smart, but we thought you should know. tell your friends something other than this -- the new oxford american dix nare nary has named the word refudiate coined by sarah palin in a tweet last summer as 2010's word of the year. they're putting it in the dictionary. it describes it this way, refudiate, verb, used loosely to mean reject.

"dancing with the stars" last night bristol palin, does it feel like the season has gone on for seven years? i think we're down to the final four i'm told. bristol palin still there. apparently she's not the best dancer in the world but dancing her heart out, she's got a big following, everybody is excited about it. last night, i don't have to tell you this, doing the paso doble, perhaps the most exciting of all. last night her mom governor palin was on the front row to cheer her on. they do these pieces to suck you in and get you emotional about the deal. the governor and bristol talked about bristol's pregnancy a couple years ago. >> our little world kind of stopped spinning the day that bristol came to us and told us she was pregnant. naive us thought, it couldn't happen to our family.

you know. it wasn't long after that, that i was tapped to be the vice presidential nominee for the republican party and here bristol was, her baby bump growing on a national stage for all the world to see. for people to jump to assumptions thinking i was just some trashy, disgusting girl that was knocked up, oh look, look at that sleaze, she's 17 and pregnant, no, i've slept with one guy in my life, had an on and off boyfriend, and it was a challenge to go through that. >> we'll find out if bristol sticks around. have you been following the love affair between snooki and senator john mccain? it's been weird. snooki said on "jersey shore" she voted for mccain. she was excited and tweeted her. here's what he posted on monday. arizona senator happy birthday at snooki. that's from united states senator john mccain, wishing snooki a happy birthday. snooki replied on her tweet,
